Drivers can now clear traffic tickets and in certain cases see a judge face to face using video kiosks located in a few San Antonio grocery stores.

As reported by WOAI.com News, video kiosks connected to the municipal court put people face-to-face with a judge, allowing everyone to skip the hassle of driving down to the courthouse.  The video kiosk allows you to talk to someone immediately at the court and a clerk will first screen a case then bring in a judge to take a plea. Those who use the kiosk will be able to request probation or a driver’s safety course and pay for the ticket at the kiosk.

New bill that is working its way through state Senate would add restrictions to the red light camera ticketing process (big ones), and work in favor of wrongfully ticketed motorists.

The goal of the bill is said to protect the rights of drivers who are erroneously ticketed. The bill, authored by Senator Joe Simitian, would prohibit tickets that are sent out by the police departments requesting information on the identity of the driver in order to have the ticket cleared. Red Light traffic enforcement cameras are set up at intersections to get a clear shot of you running a red light. If the photo isn’t clear enough then the employees viewing the photos may disregard the ticket since they don’t have clear evidence.

The next step if the police feel they have enough evidence is usually to send you a notice asking you to sign a form and mail back to them. At this point if you don’t fill out the form and mail it back then there is no real ticket in the mix. A real ticket isn’t filed with the court till you send back that form identifying yourself as the driver or someone else.

If you are concerned about getting a red light ticket in the mail, you won’t have to worry for too long. If it’s been more than 2 weeks since the time you think you set off the red light camera then chances are you won’t be getting a ticket. In July of 2011 the City of Los Angeles chose to shut down their Red Light Traffic Enforcement Cameras set up at various intersections around the city. There has been much confusion since then because there are still cities within the County of Los Angeles that ARE still issuing tickets. You don’t want to wind up paying for a ticket when you didn’t have to in the first place do you? This is a topic we have blogged about in the past but it’s important enough to revisit, because too many people receive notices from police departments or out of state camera company that are meant to fish for information, like your driver’s license number, and to get you to tell on yourself (or someone else) for a red light violation.

Either on the notice itself or an attach page, will be blank lines with fields for you to fill in. If you don’t fill out the back of this notice and send it back to the agency requesting the information from you then they won’t have enough to pin the violation on you and a get a real ticket issued to you through the court. Once you give up this information, the information can be used to get a real ticket filed with the courthouse.

Be very suspicious if you don’t the court house listed on the notice. Be wary if you don’t see a due date.  Be careful if you don’t see a fine amount listed.  You could even go so far as to go on the website for the court in the county the violation supposedly occurred in and do a search for the ticket. You could also try calling the court you think the ticket would have been issued in and inquire if there is any record of a ticket being issued to you, most likely there will not be!

By law ( California Vehicle Code section  21200) , “Every person riding a bicycle upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, except those provisions which by their very nature can have no application.” Essentially this means that cyclists are to act and be treated as drivers of cars. However many inexperienced or non professional bicyclists are not aware that the vehicle code applies to them while they are on a non-motor driven device, moved exclusively by human power. Unfortunately, this is no excuse, and while it may seem unfair, bicyclists (of any level of experience) are expected to know the rules of the road and abide by them.

It is true a driver of a bicyclist can be cited for a red light, a stop sign violation, for wearing ear plugs in both ears while riding, etc. What more, is that many of the  violations committed while on a bicycle will carry a point (or more) and can affect your driver’ s license and insurance rates. Luckily a ticket issued to a bicyclist can be fought or contested in the same way as a ticket received while driving a car.

The California Vehicle Code only requires that warning signs be posted to notify drivers of camera enforced intersections and that these signs be posted either at all approaches to the intersection or at all main entrances into a city including (freeways, bridges, and state highway routes).

 

Many times you will see warning signs posted right next to the traffic signal light, however not always. Sometimes warning signs might even be posted at the previous, non- camera enforced intersection which can be misleading or cause confusion. So while a City may not be in violation of the Vehicle Code requirements if they don’t have warning signs placed at the intersection (since they have a choice in the placement), if any signs you do find are blocked or damaged in a such a way you can’t see them, then you may have something that can help you in getting your ticket dismissed because warning signs do have to be reasonably visible. As many know, Los Angeles has announced plans to stop using cameras to enforce red light violators at numerous intersections throughout the city. While many are rejoicing that the cameras may be shut down by the end of June, don’t forget about the red light ticket you currently have! The program ending would prevent future red light camera tickets from being issued but  don’t assume that any current red light camera ticket you have from the City of Los Angeles will just automatically vanish if the red light camera system ends. To avoid potential problems just be sure to follow up on any outstanding tickets. You can always check the status of your ticket on the court website to see if it is still active or closed. Remember if the ticket is already filed and active with the court before the city’s red light program ends (if in fact does end) then it may not automatically be dropped and if you don’t follow up on the ticket it may go to collections or affect you negatively in other ways if the DMV is notified (LA courts exercise their own discretion and can choose to refer your information to a collections agency OR the DMV OR Both, although it is rumored they usually stick with the first option). –  blog submitted by ticketbust.com, helping drivers contest and dismiss their traffic tickets.
