This bill seeks to amend the Vehicle Code to require all yellow lights at camera enforced intersections be lengthened by one second. Drivers can now clear traffic tickets and in certain cases see a judge face to face using video kiosks located in a few San Antonio grocery stores.

As reported by WOAI.com News, video kiosks connected to the municipal court put people face-to-face with a judge, allowing everyone to skip the hassle of driving down to the courthouse.  The video kiosk allows you to talk to someone immediately at the court and a clerk will first screen a case then bring in a judge to take a plea. Those who use the kiosk will be able to request probation or a driver’s safety course and pay for the ticket at the kiosk.

Red Light Camera Bill May Eliminate Certain Rights

Many cities all across California are no longer using red light camera enforcement. Many believe this is due to the fact cities are losing money since so many red light camera tickets are being thrown out by judges.

A new California Assembly Bill (666) introduced by Assemblyman Bob Wieckowski, seeks to make red light camera tickets administrative tickets. As reported by OC Weekly those who are not in favor of the bill believe it:

  •     Eliminates Your Right to a Trial if You Get a Red Light Camera Ticket
  •     Makes You Responsible for the Ticket Even When Someone Else Is Driving
  •     Sets up “Administrative Hearing” Courts Run By Those Who Gave You the Ticket
  •     Makes it so no Evidence Other than the Ticket Itself is Needed to Convict You
  •     Leaves no Right to Face Your Accuser
  •     Makes it so you Are Assumed Guilty and Have to Prove Your Innocence
  •     Makes it so You Will Have to Pay a Fee If You Want Your Case Heard in Court
  •     Expands the Use of Photo Enforcement to Other Traffic Violations

New bill that is working its way through state Senate would add restrictions to the red light camera ticketing process (big ones), and work in favor of wrongfully ticketed motorists.

The goal of the bill is said to protect the rights of drivers who are erroneously ticketed. The bill, authored by Senator Joe Simitian, would prohibit tickets that are sent out by the police departments requesting information on the identity of the driver in order to have the ticket cleared. Californians may soon get the long awaited question answered: “Is or Isn’t Red Light Camera Evidence Admissible, and if so what are the Rules”.

Two recent court of appeal cases (People v. Borzakian and People v. Goldmith) each decided differently as to the reliability, accuracy, and admissibility of the evidence (namely photographs and video) gathered by red light camera enforcement systems used in court by officers during their testimony. The Supreme Court of California has agreed to first review People v. Goldsmith. The review of Borzakian will be dependent upon the outcome of the Goldsmith review. In any event the Supreme Court Decision will be very important to the area of red light camera tickets. Red Light traffic enforcement cameras are set up at intersections to get a clear shot of you running a red light. If the photo isn’t clear enough then the employees viewing the photos may disregard the ticket since they don’t have clear evidence.

The next step if the police feel they have enough evidence is usually to send you a notice asking you to sign a form and mail back to them. At this point if you don’t fill out the form and mail it back then there is no real ticket in the mix. A real ticket isn’t filed with the court till you send back that form identifying yourself as the driver or someone else.

If you are concerned about getting a red light ticket in the mail, you won’t have to worry for too long. If it’s been more than 2 weeks since the time you think you set off the red light camera then chances are you won’t be getting a ticket. Last summer the city of Los Angeles decided to stop using red light cameras to ticket violators. It was rumored that an LA City Red Light Camera tickets did not have to be paid however it was never made official. Until now…

Just recently, the media has been buzzing after the Los Angeles Police Commission made an announcement that they would no longer be pursuing those with unpaid Red Light Tickets issued by city of Los Angeles.

Unfortunately this recent buzz has also caused much confusion. People are wondering if they still have to pay for a ticket issued, not necessarily in the City of LA, but the County of LA, and if they currently have a court date set up for an old red light camera ticket issued by the City of LA if they still have to show up?

There are still cameras being operated throughout the county of LA and if you received one of those, it is unfortunately a valid ticket. As for red light camera tickets issued by the City, the cameras were shut off last summer so you should not have received one after that time period.

If you received one prior to the time they were shut off and never responded to the court to pay the thing rumor has it you no longer have to pay. In July of 2011 the City of Los Angeles chose to shut down their Red Light Traffic Enforcement Cameras set up at various intersections around the city. There has been much confusion since then because there are still cities within the County of Los Angeles that ARE still issuing tickets. You don’t want to wind up paying for a ticket when you didn’t have to in the first place do you? This is a topic we have blogged about in the past but it’s important enough to revisit, because too many people receive notices from police departments or out of state camera company that are meant to fish for information, like your driver’s license number, and to get you to tell on yourself (or someone else) for a red light violation.

Either on the notice itself or an attach page, will be blank lines with fields for you to fill in. If you don’t fill out the back of this notice and send it back to the agency requesting the information from you then they won’t have enough to pin the violation on you and a get a real ticket issued to you through the court. Once you give up this information, the information can be used to get a real ticket filed with the courthouse.

Be very suspicious if you don’t the court house listed on the notice. Be wary if you don’t see a due date.  Be careful if you don’t see a fine amount listed.  You could even go so far as to go on the website for the court in the county the violation supposedly occurred in and do a search for the ticket. You could also try calling the court you think the ticket would have been issued in and inquire if there is any record of a ticket being issued to you, most likely there will not be!
